Library in Chapel Hill. 1. Additions or Changes to the Agenda PUBLIC CHARGE The Board of Commissioners pledges to the citizens of Orange County its respect. The Board asks its citizens to conduct themselves in a respectful, courteous manner, both with the Board and with fellow citizens. At any time should any member of the Board or any citizen fail to observe this public charge, the Chair will ask the offending person to leave the meeting until that individual regains personal control. Should decorum fail to be restored, the Chair will recess the meeting until such time that a genuine commitment to this public charge is observed. All electronic devices such as cell phones, pagers, and computers should please be turned off or set to silent/vibrate. 2. Public Comments (We would appreciate you signing the pad ahead of time so that you are not overlooked.) a. Matters not on the Printed Agenda b. Matters on the Printed Agenda (These matters will be considered when the Board addresses that item on the agenda below.) 3. Proclamations/ Resolutions/ Special Presentations a. Resolution Honoring Joe Thompson – 2010 Small Farmer of the Year RECOGNIZED The Board will recognize Mr. Joseph A. Thompson, owner and operator of Thompson Prawn Farm, as the 2010 Gilmer L. and Clara Y. Dudley Small Farmer of the Year through the Cooperative Extension program at North Carolina A&T State University and authorize the Chair to sign the resolution. b. Recognition of Tax Administrator Jo Roberson - Recipient of the William A. Campbell Award RECOGNIZED (Item added to the agenda) 4. Consent Agenda a. Minutes APPROVED with CHANGES The Board will consider correcting and/or approving the minutes from May 6, 11 and 13, 2010 as submitted by the Clerk to the Board. b. Appointments (1) Hillsborough Board of Adjustment – Reappointment APPROVED The Board will consider making a reappointment to the Hillsborough Board of Adjustment. (2) Orange County Planning Board – Reappointments APPROVED The Board will consider making reappointments to the Orange County Planning Board. (3) Workforce Development Board-Regional Partnership – Reappointments APPROVED The Board will consider making two reappointments to the Workforce Development Board-Regional Partnership. c. Property Tax Refund APPROVED The Board will consider adoption of a refund resolution related to one request for property tax refund in accordance with North Carolina General Statute 105-381. d. Property Tax Refund Request APPROVED The Board will consider adoption of a refund resolution related to one request for property tax refund in accordance with North Carolina General Statute 105-381. e. Property Tax Releases APPROVED The Board will consider adoption of a resolution to release property values related to thirteen requests for property tax release in accordance with N.C. General Statute 105-381. The Board will consider approving an agreement renewal for FY 2010-11 between the County and the City of Durham to provide Animal Control Services for the very small potion of the City located within Orange County. The Board will consider approving an agreement renewal to provide the Town of Hillsborough with animal control and emergency animal after hour call services from July 1, 2010 through June 30, 2011 for a set fee of $25,160. The Board will consider a request approving an agreement renewal that provides the Town of Chapel Hill with animal control and emergency after-hour animal services from July 1, 2010 through June 30, 2011 and that address how pet license fees for Chapel Hill residents will be collected. And authorize the Chair to sign, subject to review by the County Attorney. The Board will consider approving an agreement renewal with the Town of Carrboro to provide the Town with emergency after hour animal services during FY 2010-11 and address how pet license fees for Carrboro residents will be collected and authorize the Chair to sign. The Board will consider renewing the annual contract with the Hyconeechee Regional Library System that establishes operational and financial responsibilities for coordinating library services among the counties of Caswell, Orange and Person, and to authorize the renewal of the agreement between the Hyconeechee Regional Library System and Orange County to provide professional services for a Hyconeechee Regional Library System Director and authorize the Chair to sign. k. General Engineering and Environmental Management Services Agreement for Solid Waste Management APPROVED The Board will consider approving an agreement for general engineering and environmental services for the Solid Waste Management Department with HDR Engineering, Inc. of the Carolinas for professional engineering services for three years commencing on June 10, 2010 and authorize the Chair to sign. l. Bid Award Ambulance for Emergency Services APPROVED The Board will consider awarding a bid for the purchase of one ambulance to Excellance, Incorporated of Madison, Alabama. m. Fairview Park Utilities Right of Way Agreement with Duke Energy APPROVED The Board will consider approving an agreement for the dedication of Right of Way to Duke Energy for the installation and maintenance of electrical utilities built to service the Orange County Fairview Park facility and authorize the Chair to sign. n. Orange County Comprehensive Transportation Plan (CTP) Process Plan APPROVED The Board will consider directing the Comprehensive Transportation Plan Steering Committee to continue with data collection, data projections, alternative selection and analyses, and development of the plan with public input to include NC 86 as a strategic highway corridor, with a phased plan for improvements to a future expressway as an ultimate configuration. 5. Items Removed From Consent Agenda 6. Public Hearings The Board will consider adoption of County initiated amendments to certain sections of the Zoning Ordinance, the Zoning Atlas, and Chapter 5 of the 2030 Comprehensive Plan Land Use Element Text and Map and close the pubic hearing. The Board will conduct a public hearing to solicit comments from the public on a possible November 2, 2010 Special Advisory Referendum concerning the Levy of a One-Quarter Cent County Sales and Use Tax. 7. Regular Agenda a. Draft Comments – Proposed Falls Lake Nutrient Management Rules APPROVED with CHANGES The Board will consider draft comments for submittal to the N.C. Environmental Management Commission on the proposed Falls Lake Nutrient Management Rules, which are to be presented for public comment this summer. The Board will consider a recommended Code of Ethics to guide the Commissioners in the performance of their duties and to consider recommending the General Assembly repeal portions of Session Law 1987-460. c. Orange County Funding Support for the Town of Chapel Hill Library DISCUSSED The Board will consider discussing Orange County’s funding support for the Town of Chapel Hill Library. 8. Reports a. Report - Update on the UNC Bingham Facility REPORT RECEIVED The Board will receive an update on various issues pertaining to University of North Carolina’s Bingham Facility, and to receive information from university representatives. 9. Orange County Board of Adjustment – Appointment APPROVED The Board will consider making an appointment to the Orange County Board of Adjustment. b. Hyconeechee Regional Library Board – New Appointment APPROVED The Board will consider making a new appointment to the Hyconeechee Regional Library Board. c. Orange County Nursing Home Community Advisory Committee – New Appointment APPROVED The Board will consider making an appointment to the Orange County Nursing Home Community Advisory Committee. d. Orange-Person-Chatham Area Programs Board – New Appointment APPROVED The Board will consider making a new appointment to Orange-Person-Chatham Area Programs Board. 12.
